Terms of Service
These Terms of Service (“Terms”) govern your access to and use of MorningBrief. By signing up for or using the service, you agree to these Terms.
1. The Service
MorningBrief reads your upcoming calendar events and the associated Salesforce account history to generate a daily pre-call briefing email. The service is provided on a subscription basis.
2. Your account
- You must provide accurate registration information and keep your login credentials confidential.
- You are responsible for all activity that occurs under your account.
- You must be at least 18 years old and authorized to bind your employer (if signing up on behalf of a company) to these Terms.
3. Authorization to access your data
By connecting your Google Calendar or Salesforce account, you authorize MorningBrief to access the data described in our Privacy Policy solely for the purpose of generating and delivering your briefs. You may revoke this authorization at any time.
4. Acceptable use
You agree not to:
- Use the service in violation of any law or third-party rights.
- Resell, sublicense, or expose the service to users other than the seats you are licensed for.
- Reverse engineer, scrape, or probe the service for security vulnerabilities without prior written authorization.
- Use the service to send spam, phishing, or other abusive communications.
- Connect a Salesforce org or Google account that you are not authorized to access.
5. Subscription and billing
- Paid plans are billed monthly or annually in advance, depending on the plan you select.
- All fees are quoted in US Dollars and are non-refundable except where required by law.
- You may cancel at any time from your dashboard; cancellation takes effect at the end of the current billing period.
- We may change pricing with 30 days’ notice; changes take effect at your next renewal.
6. Free trials and beta features
We may offer free trials or beta features at our discretion. These are provided “as is” and may change, be limited, or be discontinued at any time without notice.
7. Intellectual property
MorningBrief, including all software, content, and trademarks, is owned by MorningBrief and protected by US and international intellectual-property laws. You retain all rights to the data you connect to the service.
8. Termination
We may suspend or terminate your account if you materially breach these Terms or if your use of the service poses a security or legal risk. You may delete your account at any time by emailing support@usemorningbrief.com.
9. Disclaimer
MorningBrief is provided “as is” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that briefs will be error-free, that delivery will be uninterrupted, or that any specific business outcome will result from use of the service.
10. Limitation of liability
To the maximum extent permitted by law, MorningBrief’s total liability for any claim arising out of or relating to these Terms or the service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.
11. Indemnification
You agree to indemnify and hold MorningBrief harmless from any third-party claim arising out of your misuse of the service, your breach of these Terms, or your violation of any law or third-party rights.
12. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising under these Terms will be resolved exclusively in the state or federal courts located in Delaware.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by email to active users at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the updated Terms.
